Ashalee Wall – General Terms of Use for Commercial Use

By downloading these images you are agreeing to the terms
of this user license.

I am the soul owner and copy write holder of all my commercial use items. You are purchasing a license to use my items. You can not claim any commercial use items as your own.

Commercial use license is for digital scrap booking only. No print on demand or outside use is permitted unless you buy a extended license. Please contact me for details.

License Agreement Commercial Use:
You may use these designs to modify or create new art and or graphics. You may not redistribute these
items AS IS in their original form. Be creative make it your own. Cluster it or color it but don’t just dump my commercial use items into your kit and call it done.

Do not save them in other formats and redistribute as such. You may not share my items or offer them for freebies. These files are not to be redistributed in groups. License is for individual use only.

Brushes:
All Brush sets are for creative Use only,
DO not resell the brushes individually or in packs,
DO not include Brush files or Png files associated with The brush packs in Scrap kits.

PNG’s:

You may color the png files and create elements for sale.

Overlays and textures:

All Overlays are just that Overlays and are to be used in your background /element creations.
You may not include any overlay in a scrap kit as a add on or element unless you have altered it to be yours.

You may alter color mix and match overlays to your liking.
You may not resell overlays individually or in packs

Doodles:

You may use doodles as doodle files in your scrap kits as long as you do not use more than 30% of my doodles at once.

Any other element files:

you may use elements free as your need arises.
You may not make complete element packs only from my elements.
You may make element packs if you are mixing my elements into other elements.
( for instance: bows on frames etc)

If you are a template designer please e mail us prior to use of my commercial items on your templates.

Ashalee Wall – General Terms of Use for Personal Use

These creations are for personal use as outlined below.
They are not to be re-distributed in any way, used for commercial purposes
or claimed as your own. Please give proper credit to the creator.

PERMITTED USES:

1. You may:

(a) use and incorporate the Content in your personal scrapbooking layouts;

(b) alter Content by changing the size, color, adding to or deleting from said Content.

(c) use my products for tutorials. You must direct your readers to my site(s) to upload
or purchase the product. Sharing of my products is not allowed in any form. If you have
a large group that will be using an item for purchase, please contact me in advance. I
would be happy to issue a coupon to your group for a discounted purchase.

(d) use portions of this kit in your layouts that are submitted to scrapbooking and/or
related magazines and websites for publication as long as proper credit is given to
Ashalee Wall Designs and a link is provided to the store where you purchased the product
(please see store listing below) and/or digitalpinkink.com

(e) print a hardcopy of Content to be used in your personal scrapbooking projects.

(f) make one (1) copy of the Content solely for back-up purposes; you must reproduce all
proprietary notices on this single back-up copy;

PROHIBITED USES:

2. You may not do anything with the Content that is not expressly permitted. You may not
provide a copy of the Content, or any portions thereof, to anyone or allow anyone to gain
access to the Content, or any portion thereof, except as permitted above. For greater
certainty, you may not:

(a) use the Content in design template applications for resale, including, without limitation,
website templates, flash templates, and brochure design templates;

(b) display the Content on websites designed to induce sales of “print on demand” products,
including postcards, mugs, t-shirts, posters and other items (this includes custom designed
websites as well as sites such as Cafe Press (i.e. www.cafepress.com );

(c) claim Content or altered Content as your own. You may not alter these graphics and call
them your own. You may not take any part of these graphics and add it to your graphic and
claim the resulting graphic as your own.

(d) use the Content or any part thereof as part of a trade-mark, design-mark, trade-name,
business name, service mark, or logo;

(e) incorporate the Content in any product that results in a re-distribution of the Content
(such as electronic greeting card web sites);

(f) use the Content in a fashion that is considered pornographic, obscene, defamatory or
libelous in nature;

(g) use any image in the Content that depicts a person to endorse a business, product or
service;

(h) use Content to create obscene, defamatory, or immoral works.

(i) remove any notice of copyright, trade-mark or other proprietary right from any place
where it appears on or in the Content or its accompanying materials;

(j) sub-license, resell, rent, lend, or otherwise distribute the Content;

(k) post a copy of the Content on a network server or web server for use by other users; or

(l) transfer the rights to the Content or accompanying materials (if applicable), except as
specifically provided for elsewhere in this Agreement.

(m) make any Content into tubes or brushes and redistribute them in any way.

(n) offer Content on any webpage for download, send them through a list such as a news or
Yahoo group or include them in any graphics collection either on the internet or otherwise.
This includes any thing that you would deem as Fair Use. There is no reasonable application of
scrapbooking materials that would fall under “Fair Use” guidelines.

(o) You may not provide the editable pieces of the kit to anyone else under any circumstances.

(p) My designs may not be used to create Quick Pages, Desk Tops, blog backgrounds or any other
item that is intended to be sold or given to the general public as a “freebie” on a blog or
any other website. You may make these items for your personal use, however, you may not
share them.

IF A LAYOUT USING THE INCLUDED DESIGNS IS SUBMITTED FOR PUBLICATION:

You agree to give proper credit to the copyright holder, in the publication. Follow this example:
“Patterned Papers and Elements from (Kit name) by Ashalee Wall available at www.digitalpinkink.com,
www.oscraps.com.
